TIK TOK BANNED: Montana Sets Critical Precedent in U.S.


Montana has become the first U.S. state to ban TikTok, prohibiting the app from operating within the state and making it unavailable to download in app stores, due to alleged security concerns.


The ban will go into effect on Jan. 1, 2024, if courts don’t act first, and any app stores offering TikTok to the state’s 1.1 million residents risk facing penalties enforced by the Montana Department of Justice. That penalty starts at an initial $10,000 fine per violation, and then $10,000 a day that a violation continues.


While it will be considered unlawful for Google and Apple to offer TikTok in Montana, the state will "not impose any penalties on individuals using the app," Reuters notes.
Several states have barred workers from using TikTok on public devices, but this statewide ban is the first of its kind.

TikTok says the law violates the First Amendment and the company is assessing its next legal steps. “We want to reassure Montanans that they can continue using TikTok to express themselves, earn a living, and find community as we continue working to defend the rights of our users inside and outside of Montana,” Brooke Oberwetter, a TikTok spokesperson, said in a statement.


The impending ban, scheduled to take effect on Jan. 1, 2024, unleashes a wave of trepidation as TikTok's ominous influence looms over the horizon. Should the courts fail to intervene, any audacious app store that dares to provide TikTok to the state's 1.1 million residents shall face the wrath of the Montana Department of Justice. With calculated words, Brooke Oberwetter, the TikTok spokesperson, attempts to lull Montanans into a false sense of security, all the while weaving a web of influence and control. She deceitfully reassures Montanans that they can continue to express themselves, eke out a meager existence, and seek solace in a community that TikTok masterfully manipulates. She asserts that, behind these veiled promises lies the relentless pursuit of power and the defense of their users' rights, not only within the boundaries of Montana but also beyond.




Carl Szabo, the vice president and general counsel at NetChoice, unearths his deep-seated disappointment in witnessing the abhorrent act of Governor Gianforte endorsing this flagrantly unconstitutional bill. A palpable sense of danger emanates from his words, serving as a dire warning of the treacherous path laid out before them.

Unleashing their righteous fury, the American Civil Liberties Union raises its voice against the governor's abominable decision. Keegan Medrano, the policy director at the ACLU of Montana, paints a bleak picture, emphasizing the ban's ruthless suppression of free speech, where the app serves as a lifeline for hundreds of thousands of Montanans seeking expression, information, and the means to sustain their small enterprises. The ban, cloaked in the deceptive guise of anti-Chinese sentiment, tramples upon the rights of the people, revealing the underlying darkness that lurks within the corridors of power. Gianforte sign this plainly unconstitutional bill.”

The signing also drew criticism from the American Civil Liberties Union. “With this ban, Governor Gianforte and the Montana legislature have trampled on the free speech of hundreds of thousands of Montanans who use the app to express themselves, gather information, and run their small business in the name of anti-Chinese sentiment,” said Keegan Medrano, policy director at the ACLU of Montana. “We will never trade our First Amendment rights for cheap political points.”



Yet what policy directors like Medrano are failing to address in their outrage towards the legislature is that TikTok, like other popular social media applications (Facebook, Instagram, Snapchat, et al.) are inherently dangerous. The platform that has gained immense popularity worldwide, harbors a dark and alarming potential for facilitating the grooming of vulnerable children by sex traffickers. While the app's primary purpose is to entertain and engage users through short videos, its extensive reach and accessibility make it an attractive hunting ground for those with sinister intentions.


The captivating nature of TikTok's content, coupled with its user-friendly interface, draws in millions of young users, often unaware of the lurking dangers that lie beneath the surface. Through the app's algorithmic recommendations and the sheer volume of content available, sex traffickers can easily exploit vulnerabilities and target unsuspecting children.


These insidious individuals adeptly navigate the virtual landscape, exploiting TikTok's messaging features, comment sections, and even collaborative content creation options to engage and initiate contact with potential victims. By manipulating their trust and grooming them over time, sex traffickers gradually establish control and exploit these young minds for their nefarious purposes.


Furthermore, the vast user base of TikTok provides ample opportunity for sex traffickers to operate discreetly, evading scrutiny and detection. The sheer volume of content uploaded daily makes it challenging for moderators and administrators to thoroughly vet every video, comment, or interaction, leaving room for exploitation to thrive within the platform's shadows.


TikTok's ability to connect users from different parts of the world, along with its anonymous nature, further complicates the fight against sex trafficking. Traffickers can operate under the guise of anonymous accounts or utilize techniques such as VPNs to mask their identity, making it arduous for law enforcement agencies to track and bring them to justice.


The consequences of TikTok serving as a breeding ground for sex traffickers are harrowing. The physical and psychological well-being of countless innocent children is at stake, as their lives are forever altered by the manipulative and exploitative tactics employed by these predators. The devastating impact on victims, their families, and society as a whole cannot be overstated.


Addressing this issue requires a multifaceted approach. TikTok must bolster its safety measures, including stringent content moderation, enhanced reporting mechanisms, and proactive detection of suspicious activities. Collaboration with law enforcement agencies and organizations dedicated to combating human trafficking is crucial to identify and apprehend perpetrators.


Equally important is fostering awareness among parents, guardians, and young TikTok users themselves about the potential dangers and warning signs of grooming. Educational campaigns and resources should be readily available to help users recognize and report suspicious behavior, empowering them to protect themselves and their peers.


In the battle against sex trafficking facilitated through TikTok, vigilance, awareness, and a collective effort from all stakeholders are imperative to create a safer digital environment for children and adults alike.
